The difference between OEM and ODM

1. The concept is different

(1) ODM is a product design plan proposed by the entrusting party, regardless of who completes the overall design, and the entrusted party shall not provide a third party with products that adopt the design.

(2) OEM products are tailor-made for brand manufacturers, and can only use the brand name after production, and must not be produced under the producer's own name. That is, brand producers do not directly produce products and entrust other manufacturers of similar products to produce.

2. The copyright is different

(1) ODM depends on whether the brand enterprise has bought out the copyright of the product. If not, the manufacturer has the right to organize production himself, as long as there is no design recognition of the enterprise company.

(2) OEM is completed by the manufacturer from design to production, and is bought by the OEM after the product is formed. Whether the manufacturer can produce the same product for a third party depends on whether the OEM buys out the design.

3. Intellectual property rights are different

The difference between OEM and ODM, the core is who enjoys the intellectual property rights of the product, if the entrusting party enjoys the intellectual property rights of the product, it is OEM, which is commonly known as "OEM"; If it is the overall design carried out by the producer, it is ODM, commonly known as "OEM".
